This Privacy Policy explains how Lensa, Inc. (“Lensa”, “we”, “us”, “our”) collects, uses, and shares your personal information, and your choices in connection with this. This Privacy Policy (“Policy”) applies to collection of information through the Lensa website https://lensa.com (the “Website”), the FastTalent website https://lensa.com/employer/ (collectively, the “Websites”) and through other channels of communication with us (collectively, the “Services”).

We collect personal information, as further described below, directly from you and automatically as you engage with our Services. “Personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person.

2. Personal Information We Collect, How We Use It, How Long We Keep It, and How We Share It

We collect personal information as you engage with our Services.

If you are a job applicant, this includes when you:

  • Create a Job-Seeking Lensa Profile. If you create a Lensa profile as a job-seeker (a “Job-Seeking Profile”), we collect from you your personal identifiers (name, email address, and, if you choose to provide it, telephone number), your education information (education level), your professional or employment information (work experience, current position title, and, if you choose to provide it, your resume), and your job preferences (desired job location, desired salary, and company preferences). We use this personal information to create your Job-Seeking Profile, to match you with new jobs that might be relevant to you (as based on your selected job preferences, company preferences (like size of company, desired salary etc.), communicate with you about our Services, and send you email updates. You can unsubscribe at any time by clicking the “unsubscribe” link with each email. Our emails include a tracking pixel that tracks whether you open the email, and, if so, whether you subscribe to our Services. We use this information to send you additional email communications which are targeted to you and may be of interest to you, as based on your interaction with our emails and/or Website. Our use of pixel trackers may be considered a sale or share under the California Privacy Rights Act (“CPRA”). To opt out of this pixel tracking, please visit Your Privacy Choices. You can also avoid downloading the pixel by rejecting the download of images in the email. We retain support-related emails for 100 days; all other emails are retained for 30 days, after which we anonymize the information and use it to improve our customer support service. If you opt in to receive recurring, automated promotional text messages from us to the telephone number provided, you can opt out at any time by replying STOP to any text message and can reply HELP for help. We retain this information for as long as you have an account with us, after which we anonymize it.
  • Play Our Work Style Game. When you play our Workstyle game at https://lensa.com/workstyle, the game assesses your reaction to game prompts, including click count, click speed, and error rate. We use this information to categorize you into one of a number of archetypes amongst other users who participated in the game, to inform you of your results, and provide you with an assessment of the types of jobs that people belonging to that archetype may do well in. The results and conclusions provided are based only on raw data and are for you only. They will not have any effect on your job search. If you consent, we will use your archetype to filter your job search to show you jobs that are more strongly correlated to that archetype. We do not share them with any third party nor use this information to provide tailored job recommendations. We retain this information for as long as you have an account with us, after which we anonymize it.
  • Engage with job boards and/or education assistance providers. When you choose to engage with job boards, education assistance providers and similar service providers, we collect, from you, your personal identifiers (name, email address, telephone number, physical location (e.g., city, state zip code) and your professional or employer-related information (job title, work experience, desired compensation, resume, job preferences). We share this information with the relevant provider to facilitate your job application(s) and enrollment with the relevant provider’s service. The processing of your information by each provider is subject to each such provider’s terms of use and privacy notice.

If you are an employer, this includes when you:

  • Create a Hiring Lensa Profile. If you create an employer profile on FastTalent by Lensa (https://lensa.com/employer/) (a “Hiring Profile”), we collect, from you, your personal and professional identifiers (name, job title, company name, work email, telephone number), your login information (password), your selected product, and your career website along with the number of open positions at your organization. We use this information to communicate with you about your job postings and to put you in touch with applicants for your active postings. We do not share this information with any third parties. We retain this information as long as you have an account with us, after which we anonymize it. Note that our emails include a tracking pixel that tracks whether you open the email, and, if so, whether you subscribe to our Services. We use this information to send you additional email communications which are targeted to you and may be of interest to you, as based on your interaction with our emails and/or Website. If you are an affiliate, this includes when you:

  • Sign up as a Lensa affiliate. When you sign up as a Lensa affiliate on our performance marketing partner website, we collect, from you, your personal identifiers (name, telephone number, physical address, email address). If you are referred to us by another website, we collect, from the referring website, your internet or other electronic network activity information (originating website name and associated click identifier). The use of such information is governed by our Affiliate Privacy Policy. Our emails include a tracking pixel that tracks whether you open the email, and, if so, whether you subscribe to our Services. We use this information to send you additional email communications which are targeted to you and may be of interest to you, as based on your interaction with our emails and/or Website. If you are a website visitor, this includes when you:

  • Contact Us by Email or Website. When you send us a question or inquiry via email to [email protected] or on our website at https://lensa.com/contact-us, we collect your personal identifiers (name, telephone number, and/or email address). We use this personal information to respond to your questions or inquiries, troubleshoot where necessary, and address any issues you have with our Services.  We share your information with our third party email and online contact vendors, who facilitate your communication with us via the website and our support email address. Our emails include a tracking pixel that tracks whether you open the email, and, if so, whether you subscribe to our Services. We use this information to send you additional email communications which are targeted to you and may be of interest to you, as based on your interaction with our emails and/or Website.   • Provide job and company reviews. When you provide job and/or company reviews or otherwise engage with the community pages on the Website, we collect, from you, your interactions with the content, including, "likes", comments, reviews, and ratings. Because this information is publicly accessible, be mindful that it can be viewed by others or used by them as they see fit. Any comments you provide are subject to Lensa’s Community Guidelines.
  • Interact with us on social media. When you interact with our social media pages on social networking websites, such as Facebook, LinkedIn, and Instagram (each, a“Social Media Page” and collectively, “Social Media Pages”), we collect basic engagement metrics and use it to tailor content and marketing and use it to improve user experience as set forth in this section. Please note that we do not control the use or storage of the information that you have posted to any social networking websites. This information is collected and processed by the social networking websites for their own purposes, including marketing.   • Social Media Pages. When interacting with our Social Media Pages, we collect, from you, your personal identifiers (name and profile picture) as well as any information that you provide when interacting with our Social Media Pages (e.g. commenting, sharing and rating). We use this information to advertise our products, for events and invitations, and to communicate with users via the contribution and comment function.

    Because our Social Media Pages are publicly accessible, when you use them to interact with other users, for example by posting, leaving comments or liking or sharing posts, any personal information that you post in them or provide when registering can be viewed by others or used by them as they see fit.

    The content posted on our Social Media Pages or other public areas of social networking websites can be deleted in the same way as other content that you have created. If at any time you want content posted to be deleted, please email your request to [email protected].
  • Community Management. With the help of a third party, we collect, from you, your interactions with the content including "likes", shares, messages and other interactions, in order to analyze and evaluate how our content is perceived, to learn from it, and to improve our public relations efforts, and to create lookalike audiences. We use this information to create advertisements that match our Social Media Page and to disseminate them via Facebook based on demographic data.
  • Facebook Messenger; Direct Messages. When using Facebook Messenger or other direct message capabilities on Social Media Pages, the applicable Social Media Page collects, automatically, your internet or other electronic network activity information (IP address, date and time of the server request, time zone, specific browser or app function, access status, amount of data transferred, browser or app from which the Request comes, device type, operating system used, and its interface (e.g. Android or IOS), language, version of the operating system, and device identifiers). We do not use this information; its use is governed by the applicable Social Media Page’s Privacy Policy, a hyperlink to which is available above.
  • Facebook Page Insights. When you visit our Facebook Social Media Page, Facebook records your IP address and other information about your usage behavior on our Facebook Social Media Page. Facebook collects, through trackers in the browser of your device or via the advertising ID (IDFA from Apple or GAID from Google), when you open the Facebook app through your mobile device (e.g. smartphone or tablet). Facebook uses this information to create statistical evaluations for us of the use of the Social Media Page. We receive this information, from Facebook, in the form of aggregated data and anonymous statistics regarding things like: age, gender, city/country, device, inquiries from fans about other Facebook fan pages, region and language settings of the users, proportion of men and women, the number of people reached, clicks on posts, "Likes” and reactions, comments and shared content, and total video views. We do not collect or process any other personal data in connection with the page insights.

    We do not retain this information independently. For information on data protection and the storage period on Facebook in relation to the "Page Insights" function see here and Facebook’s Privacy Policy. It has been contractually agreed with Facebook that Facebook is responsible for providing you with information about the processing for Page Insights.
  • Information Processed Solely by Facebook. We do not know how Facebook uses personal information for its own purposes, how long the personal information is stored on Facebook or whether Facebook data is passed on to third parties.

    If you are currently logged in to Facebook as a user, Facebook automatically collects, through trackers on your device, your Facebook ID or a link between the Facebook ID and the advertising ID (IDFA from Apple or GAID from Google) when you open the Facebook app through your mobile device (e.g. smartphone or tablet). This enables Facebook to understand that you have visited our Facebook Social Media Page along with other Facebook pages that you have clicked on, whether you clicked on Facebook buttons integrated into websites that partner with Facebook, and other online interactions that report user data to Facebook. Based on this data, content or advertising tailored to you can be offered.
  • Interact with the Services. When you interact with the Services, we use cookies, pixels, web beacons, and other similar technologies to: (i) enable the Services to function properly; (ii) track you within the Services; (iii) enhance user experience; (iv) conduct analytics to improve the Services; (v) prevent fraudulent use of the Services; (vi) deliver targeted advertising to you; and (vii) diagnose and repair technical errors with the Services and, in cases of abuse, track and mitigate the abuse.  Thus, cookies might store information about you, your preferences, or your device, such as:
  • Usage information: We use cookies to collect information about your interaction with our website and online content, such as pages visited, frequency of access, time spent on each page, and referring website details. We use this information for analytics and marketing purposes.
  • Location Information: We use cookies to collect information about your location (zip code, city/state), which may be determined through your IP address. We use this information to recommend jobs that are in your location. You can adjust your consent to providing location information in your browser settings. We use this information for analytical purposes, to prevent fraudulent use of the Services, to enable our Services to function properly, to provide enhanced functionality, and to diagnose server and software errors, as well as, in cases of abuse, to track and mitigate the abuse.  
  • Device information: We use cookies to collect certain information about the device you use to access the website, such as hardware model, operating system, browser, and device preferences. We use this information for analytical purposes, to provide targeted advertising, to prevent fraudulent use of the Services, to enable our Services to function properly, to provide enhanced functionality, and to diagnose server and software errors, as well as, in cases of abuse, to track and mitigate the abuse.

You cannot reject essential cookies as they are necessary for the website to function. Our use of third-party marketing and analytics cookies is considered a sale/sharing under certain state privacy laws and is also considered to be what is known as interest-based advertising (IBA). Third party cookie providers to note on our Services include the below. The use of your information for analytics and advertising purposes via these cookies may be considered a sale/sharing under certain state privacy laws. To opt-out of any or all the below third-party cookies, please visit Your Privacy Choices.

  • Google Analytics. We use Google Analytics to collect information on your use of the Services for its improvement. In order to collect this information, Google Analytics may set cookies on your browser or read cookies that are already there. Google Analytics may also receive information about you from applications you have downloaded that partner with Google. We do not combine the information collected through the use of Google Analytics with personal information. Google’s ability to use and share information collected by Google Analytics about your visits to our Services or to another application which partners with Google is restricted by the Google Analytics Terms of Use and Privacy Notice. To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on, which can be accessed here or through Your Privacy Choices.
  • DoubleClick. We utilize DoubleClick by Google to serve ads based on a user’s prior visits to the Services. Each visitor to the Services receives a different cookie, and the information collected by the cookie is used to generate conversion statistics and allows us to see the total number of individuals who clicked on our ads. DoubleClick enables Google and its partners to serve ads to you based on your visits and interactions with the Services in addition to other websites on the Internet. Please review Google’s Privacy Notice for additional information on how Google uses the information collected.   • Meta Pixel. We use Meta Pixel to target our advertisements on social media to those who’ve interacted with the Services. In doing so, we share these individuals’ online interactions with the Services with Meta, which, in turn, displays targeted advertisements on social media. However, we do not have access to the information collected through Meta Pixel. This information is also stored and processed by Meta. Meta may link this information to your Meta account and use it for its own promotional purposes in accordance with Meta’s Data Usage Policy. Meta Pixel also allows Meta and its partners to show you advertisements on and outside of Meta. You can opt out of displaying Meta ads and sharing by visiting your Meta Ad Settings. If you do not have a Meta account, you can opt out of Meta ads through the Digital Advertising Alliance or through Your Privacy Choices.
  • Bing. Bing’s Microsoft Advertising Platform cookies improve advertising. We use this application to target advertisements based on what’s relevant to a user, to improve reporting on campaign performance, and to avoid showing ads the user has already seen. You can opt out of personalized advertising on Microsoft sites and services by visiting the Ads settings page on your Microsoft privacy dashboard or through Your Privacy Choices.
  • LiveRamp. We convert our customers’ personal identifiers into pseudonymous identifiers, such as advertising IDs, and share this information with LiveRamp to target our advertisements and to measure campaign performance. To opt out, please click here or visit Your Privacy Choices.
  • Microsoft Clarity. We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with the Services through behavioral metrics, heatmaps, and session replay to improve and market our Services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of certain Services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising.   • Session replay. When you visit our Services, we also automatically collect your internet or other electronic network activity information (page visits, mouse movements, clicks, scrolling) through session replay tools such as CrazyEgg. We use this information to gain insights into user behavior on the Services, to enhance its functionality, to test new features, and to optimize conversion rates. Additional uses of our users’ information:

  • Lookalikes / Custom Audiences. We partner with Meta and Google to identify and deliver targeted advertisements to individuals who have similar characteristics to those in our existing customer base (“Lookalike Audiences”). To do this, we share with Meta and/or Google, in hashed form, personal identifiers (name, email address, telephone number, city and state) from our existing customer base, as well as online user activity occurring within the Service such as Google/Meta Ad click ID. Meta and Google feed this information through their proprietary algorithms, match the hashed data with their respective user databases to identify a set of relevant Lookalike Audiences, depending on the types of information provided.   • Aggregate and deidentified data. We aggregate the data we collect for benchmarking purposes and for internal analytics as well as for marketing. We maintain, use and share this data in deidentified form. We will not attempt to reidentify the data, unless it is necessary to determine whether our deidentification processes satisfy applicable data protection laws.

Data Retention:

We may need to use and retain your personal information for longer than the periods indicated above for purposes of:

  • Compliance with our legal obligations. For example, retaining personal information where we are legally required, maintaining consent logs, and providing proof of performance for our clients, when necessary.  
  • Meeting our safety and security commitments. For example, keeping our properties secure and preventing fraud.
  • Exercising or defending legal claims. We also may need to retain personal information for longer than the periods indicated above in order to respond to legal process or enforceable governmental requests, to enforce our contracts or Terms and Conditions, including investigation of potential violations, or to otherwise protect our legal interests, in which case, the information will be retained for a period equal to the applicable statute of limitations.
  • Accounting. For example, retaining billing and payment details as part of our financial/transactional data.

3. Information Sharing

A) General Information Sharing 

In addition to the specific third-party sharing outlined above, Lensa shares personal information in the following general scenarios:

  • For the provision of our services to you: If you consent, we will share your information with other job boards, education assistance providers and similar service providers, as well as share your information and resume with resume assistance providers.
  • With service providers: We share your personal information with our service providers that assist us in providing the Services, such as our payment processors, IT support, website, email, and text message marketing providers, customer service providers, data analytics providers, communications providers, geolocation service providers, and cloud and hosting providers. These third-party service providers have access to personal information needed to perform their services, but may not use it for other purposes.
  • Within Lensa: Where necessary, we share your personal information within Lensa for legitimate business purposes, to the extent permitted by law, in order to efficiently carry out our business.  
  • In the event of a corporate reorganization: In the event that we enter into, or intend to enter into, a transaction that alters the structure of our organization, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our assets, we would share your personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We will also share your personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings. We will acquire consent where required by law.
  • For legal purposes: We will share your personal information where we are legally required to do so, such as in response to tax obligations, court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of use or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.
  • With your consent:Apart from the reasons identified above, we may request your permission to share your personal information for a specific purpose. We will notify you and request consent before you provide the personal information or before the personal information you have already provided is shared for such purpose. You may revoke your consent at any time with effect going forward.
  • With our Marketing Partners: We will share your personal information with whom we have strategic or marketing relationships or with other companies and marketers whose products or services may be of interest to you. Please see the “Use Our Website” and “Additional uses” sections above for additional information on sharing of information with marketing cookie providers.

B) Information Sharing in the Last Twelve (12) Months

For a Business Purpose.

In the preceding twelve (12) months, Lensa has disclosed the following categories of personal information for a business purpose to the following categories of third parties:

  • We have disclosed your personal identifiers, internet and other network activity information, geolocation data, professional or employment information, commercial information, and customer records information to service providers that perform services on our behalf. These service providers include IT support, website, email, and text message marketing providers, customer service providers, communications providers, geolocation service provider, and cloud and hosting provider, and email provider.
  • We have disclosed your internet or other electronic network information to our IT support to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and to identify and repair website errors that impair functionality.
  • We have disclosed your internet or other electronic network information, commercial information, and location information to our IT support and data analytics providers to maintain, improve, and upgrade the Website.

For a Sale.

  • In the preceding twelve (12) months, Lensa has shared your internet or other electronic network activity information collected via cookies and other tracking technologies with our data analytics providers and ad networks as described in Section 2 provide targeted advertising. Lensa has also shared your information with Meta and Google to identify and deliver targeted advertisements to individuals who have similar characteristics to those in our existing customer base (“Lookalike Audiences”). To opt out of such sale/sharing, please visit Your Privacy Choices.

4. Your Information Choices

In addition to the specific information choices outlined above, you have more options as to how your information is used in the following scenarios:

  • Location settings: You can prevent your mobile device from sharing your location data by adjusting the permissions on your mobile device or within the Services
  • Push notifications: If you have enabled push notifications, you may disable these at any time by updating your device settings
  • Opt out of Sharing with Affiliates and Partners: If you are a California or Colorado resident and wish to opt out of us sharing your personal identifiers with our marketing partners, please refer to the RIGHTS OF CALIFORNIA AND COLORADO RESIDENTS section under “Exercise Your Rights”.

5. RIGHTS OF CALIFORNIA AND COLORADO RESIDENTS

The California Consumer Privacy Act as amended by the California Privacy Rights Act (collectively, “CCPA”) and the Colorado Privacy Act (“CPA”) entitle California and Colorado residents (respectively) to certain rights. To the extent the CCPA and/or CPA apply to our processing of your personal information, you are entitled to the following rights:

  • Right to Access/Know. You have the right to request what personal information we have collected, used, disclosed, and sold about you, subject to certain exceptions.
  • Right to Deletion. You have the right to request the deletion of your personal information that we collect or maintain, subject to certain exceptions. For example, if we are required by law to retain the information that you are asking to be deleted, we would not be able to delete the information until we are legally permitted to delete it. 
  • Right to Opt-Out of Sale/Sharing. You have the right to opt-out of the sale or sharing of your personal information to third parties, including for targeted advertising. Lensa does not have actual knowledge that it sells or shares personal information of minors under the age of sixteen (16) years.   • Right to Non-Discrimination. You have the right to not receive discriminatory treatment if and when you exercise your rights to access, delete, opt-out, correct, or limit use of sensitive personal information under the CCPA and CPA.  
  • Right to correct: You have the right to correct inaccurate personal information that we collect or maintain.

To the extent the CPA applies to our processing of your personal information, you are also entitled to the following additional rights under the CPA:

  • Right To Opt-Out of Profiling: You have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. However, Lensa does not process personal information in a manner that gives rise to this right.
  • Right to know/appeal inaction: If you submit a request to exercise any rights under the CPA and we do not take action on your request, we will inform you of our reasons for not taking action. You can appeal by emailing us at [email protected].

Exercise Your Rights

If you are a California or Colorado resident and wish to exercise your privacy rights, you may submit a request via webform or by emailing us at [email protected]. To exercise your right to opt out of the sale/share of your information via cookies, please visit Your Privacy Choices.

For requests submitted, you must provide us with sufficient information that allows us to reasonably verify you are the person about whom we collected the personal information and describe your request with sufficient detail to allow us to properly evaluate and respond to it.  For all requests, this information includes full name and email address. If we are not able to verify your identity with the information provided, we may ask you for additional pieces of information, including, for example, details of your relationship with us (e.g., nature of relationship, date of last contact, etc.).

If you are using an authorized agent to submit a CPA or CCPA privacy request, please provide written permission, signed by the consumer, authorizing the agent to submit the request.  

6. Nevada Residents

If you are a consumer in the State of Nevada, you may request to opt-out of the current or future sale of your personal information. We do not currently sell any of your personal information under Nevada law, nor do we plan to do so in the future. However, you can submit a request to opt-out of future sales by contacting us at [email protected] regarding the sale of such information. Please include “Opt-Out Request Under Nevada Law” in the subject line of your message.

7. Information Security

We implement and maintain reasonable security measures, such as access controls and encryption, to protect the personal information we collect and maintain. However, no security measure or modality of data transmission over the Internet is 100% secure and we are unable to guarantee the absolute security of the information we have collected from you.

8. Protection of Children's Personal Information

The Services are not intended for individuals under the age of eighteen (18) years. If we learn that we have collected or received personal information from individuals under the age of eighteen (18), we will delete the personal information. If you believe we have personal information on individuals under the age of eighteen (18), please contact us at the contact information provided below.

9. Policy Changes and Applicability

Lensa reserves the right to change this Privacy Policy at any time. If we make changes, we will post the changes to this page, and will indicate the date the changes go into effect. We encourage you to review our Privacy Policy to stay informed.
